Your Consent

By providing personal information to Driverly, you consent to the collection, use, disclosure and retention of that information by Driverly in accordance with this Privacy Policy and as permitted by applicable law.

You may withdraw your consent at any time, subject to legal or contractual restrictions and reasonable notice. If you withdraw consent, Driverly may not be able to provide you with some or all services.

Personal Information

Information Driverly Collects

a) Information You Provide

You may be asked to provide personal information to Driverly when you interact with Driverly, including when you create an account, submit an application through the Website, request information, subscribe to communications or use Driverly services.

Examples include your name, contact details, address, information about your employment and income and information related to your vehicle preferences and budget.

You may choose not to provide some information. If you do not, Driverly may not be able to complete your request or provide some services.

Telephone calls with Driverly may be recorded for accuracy, training and quality assurance. Recordings may be shared with service providers to verify compliance. You may choose not to have a call recorded by ending the call and contacting Driverly in writing or by email instead.

b) Automated Collection

Driverly may automatically collect information about your use of the Website and online services, such as the date and time of your visits, the pages you view, the browser and device you use and your internet protocol address.

Driverly websites, online services, emails and advertisements may use cookies, pixels, web beacons and similar technologies to collect information that helps Driverly improve services, measure performance, personalize content, prevent fraud and provide interest based advertising.

You may set your browser to refuse some cookies, but this may affect your ability to use certain features.

Much of this automatically collected information is non personal. Where it is not personal, Driverly will treat it as non personal information.

c) Credit Reports

When you apply for or use certain services, for example when Driverly helps connect you to a dealership or finance partner for a possible vehicle purchase or financing, Driverly may obtain your credit score and related information from a credit reporting agency to process or fulfill your request.

Driverly may periodically obtain updated credit information to maintain your confidential profile for use by Driverly in accordance with this Privacy Policy. On request, Driverly will tell you if such a report was requested and provide the name and address of the credit reporting agency.

Dealers and other partners to whom Driverly has disclosed your personal information may also request credit reports about you for legitimate purposes related to your application or account with them. Their use of those reports is governed by their own policies and by law, not by this Privacy Policy.

d) Information about Referred Transactions

If Driverly refers you to an independent business, such as a dealership or finance partner, Driverly may receive information about your dealings with that business, such as whether a transaction was completed and on what general terms. Driverly uses this information to update your confidential profile and improve services.

How Driverly Uses Personal Information

Driverly uses personal information for purposes related to your relationship with Driverly and as permitted or required by law, including:

To create, administer and manage your Driverly account and profile.

To process your applications, submissions, requests and communications.

To connect you with participating dealerships and partners based on your submitted information.

To provide services to you and to communicate with you about those services.

To send you information and offers regarding Driverly products and services and related products and services offered by selected partners, as permitted by law and your communication preferences.

To manage contests, promotions and other programs.

To improve existing services, develop new services and enhance the Website and user experience.

To protect Driverly rights and interests, including to detect and prevent fraud and abuse and to enforce agreements.

To support these purposes, Driverly may create and maintain a confidential profile about you.

Driverly may share your personal information within the Driverly Group so that each member can use it for the purposes described in this Privacy Policy.

Driverly may use interest based advertising services provided by third parties such as Google or Meta to display ads on other websites or platforms to users who have visited Driverly sites. These services use cookies or similar tools. You can adjust some advertising settings with those providers or through industry opt out tools.

How Driverly Discloses Personal Information

Driverly may disclose personal information as follows and as otherwise permitted by law.

a) With Your Consents

Driverly may disclose your personal information as you authorize during your interactions with Driverly.

b) Referred Transactions

If Driverly refers you to an independent business, such as a dealership, lender or other partner, Driverly may disclose necessary personal information, including your application details and credit related information where permitted, so that the business can assess and respond to your request.

Driverly does not control how those independent businesses use, disclose or retain your personal information. Their practices are governed by their own privacy policies and by law, not by this Privacy Policy.

c) Suppliers and Service Providers

Driverly may disclose personal information to suppliers and service providers who help Driverly operate its business and provide services, such as hosting providers, analytics services, call centers, fraud prevention services, marketing vendors and payment processors. These suppliers are authorized to use personal information only as necessary to provide services to Driverly.

d) Law Enforcement and Legal Disclosures

Driverly may disclose personal information as required or permitted by law, including to comply with court orders, subpoenas or lawful requests from government authorities.

Location of Personal Information

Driverly and its service providers may process, store and use your personal information in Canada, the United States or other countries.

Privacy laws in those countries may differ from the laws in your home jurisdiction and government authorities in those countries may be able to access your information without notice. By providing personal information to Driverly you consent to these transfers.

Retention of Personal Information

Driverly retains personal information for as long as is reasonably necessary for the purposes set out in this Privacy Policy and to comply with legal obligations and enforce or protect legal rights, or for any longer period required or permitted by law.

When personal information is no longer required, Driverly will delete, destroy or anonymize it in a reasonably secure manner.

Driverly uses reasonable physical, administrative and technical safeguards appropriate to the sensitivity of the information in order to protect personal information in its possession or control from unauthorized access, use, disclosure, alteration or loss.

Driverly may create or collect information that is not personal information, for example by aggregating or anonymizing personal information so it no longer identifies an individual.

Driverly may use, disclose, transfer and retain non personal information for any purpose and in any manner, subject to applicable law. If non personal information is combined with personal information and can identify an individual, Driverly will treat the combined information as personal information while it remains identifiable.

Other Websites and Businesses

Driverly websites and emails may contain links, advertisements or references to products and services offered by independent businesses, including dealerships, lenders, credit card providers and other partners.

Driverly is not responsible for those websites, services, products or privacy practices. This Privacy Policy does not apply to them.

Other Matters

The agreements you accept when you use Driverly services, including the Driverly Terms of Use and the Driverly Terms of Service, contain important provisions regarding disclaimers, limitations of liability, dispute resolution and governing law. Those provisions apply to any dispute that may arise in relation to this Privacy Policy or Driverly handling of personal information, to the extent allowed by law.

Driverly may change this Privacy Policy from time to time by posting a new version on the Website. Driverly handling of personal information is governed by the version in effect at the time of collection, use or disclosure.
